DMCA Takedown Policy

BurdsNerds, operated by Matthew L. Burd, respects the intellectual property rights of others and expects users and clients to do the same. This policy outlines our procedures for responding to claims of copyright infringement under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.

1. Reporting Claimed Infringement

If you believe that content on burdsnerds.com infringes upon a copyright you own or control, please send a written notice containing all of the following to our designated agent:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on the Site (e.g., the URL).
  4. Your contact information, including name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

We will respond to valid DMCA notices promptly. Incomplete notices may not receive a response.

3. Counter-Notification

If you believe content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice containing:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or San Diego County, California, if your address is outside the United States).

4. Repeat Infringers

BurdsNerds reserves the right to terminate, in appropriate circumstances, the accounts or relationships of users or clients who are repeat infringers of intellectual property rights.

5. Limitation of Liability

Nothing in this policy constitutes legal advice. BurdsNerds strongly recommends consulting an attorney before filing a DMCA notice or counter-notice, as submitting a false claim may result in legal liability.
